What does 'presumptive condition' mean?

A presumptive condition is one the VA automatically assumes is connected to your service — you do not have to prove the medical link (nexus) yourself. If you served in a qualifying location and time period and have a condition on the presumptive list, you only need the diagnosis and proof of qualifying service.

Who qualifies under the PACT Act?

The PACT Act expanded presumptive eligibility for veterans exposed to burn pits and airborne hazards (Gulf War and post-9/11 era), Agent Orange (Vietnam era, with expanded locations), and radiation. Gulf War and post-9/11 veterans who served in Iraq, Afghanistan, and other Southwest Asia locations are the largest newly covered group, and the list of covered conditions has continued to grow through 2026.

What conditions are presumptive?

The list includes more than 20 burn pit and toxic exposure conditions — among them several respiratory cancers, chronic bronchitis, COPD, chronic rhinitis, chronic sinusitis, and glioblastoma — plus hypertension and MGUS for Agent Orange exposure. My claim was denied before the PACT Act — can I refile?

Yes. If you were previously denied for a condition that is now presumptive, file a supplemental claim (VA Form 20-0995). The VA encourages veterans denied before the PACT Act to reapply, and approval rates for now-presumptive conditions are substantially higher.

Do I need to pay someone to file a PACT Act claim?

No. Presumptive claims are among the most straightforward to file because the hardest part — proving the service connection — is already done by law. An accredited VSO will file it for free. Be especially wary of companies charging fees for PACT Act claims; this is a common claim-shark pitch.
