2026 Updates & Recent Florida Veteran Legislation

Florida lawmakers have continued layering on protections for veterans through the 2024–2026 sessions, mostly aimed at shielding benefits, expanding long-term care access, and boosting employment.

  • Veterans' Benefits Protection / SAVE Act (SB 910, 2025). Governor Ron DeSantis signed the Safeguarding American Veteran Empowerment (SAVE) Act in 2025. The law caps fees, prohibits upfront and nonrefundable charges, bans referral fees, and requires disclosures and background checks for anyone offering paid help with VA claims, a direct response to predatory "claim shark" companies.   • Long-Term Care Access (HB 797, 2025). HB 797 streamlines admission to the Florida State Veterans' Homes by removing Certificate of Need bureaucratic obstacles for veterans and their spouses, accelerating timelines for skilled nursing placements.

  • FY 2025–2026 Budget Investments. The signed FY 2025–2026 state budget continued a $2 million investment in veteran skills-based employment and small-business support, plus $1 million for the Veterans' Dental Care Grant Program administered through nonprofit partners. (floridavets.org)

  • Property Tax Refund for New Homesteads. A 2022 statutory change (effective tax year 2023, first applied to the 2024 tax roll) lets disabled veterans apply for a prorated refund of property taxes paid on a newly acquired homestead, eliminating the old "wait until next January 1" gap.

  • Amendment 6 Spouse Protection (in effect since 2021). Florida voters approved Amendment 6 with nearly 90% support; surviving spouses of older combat-disabled veterans now retain the homestead property-tax discount the veteran had earned in life.

Florida Property Tax Exemptions for Veterans

Florida's property tax breaks are among the most generous in the country. Combined with no state income tax, this is the headline financial benefit for most Florida veterans. The exemptions live in Florida Statutes 196.081 and 196.24 and are administered by your county property appraiser.

Disabled Veteran Homestead Exemption

Veterans with a service-connected disability rating of 10% or higher and a Florida homestead qualify for an additional $5,000 reduction in assessed value. This stacks on top of the standard $50,000 homestead exemption. You must own and occupy the home as your permanent residence as of January 1 and provide a current VA disability rating letter.

Total & Permanent Disability Exemption (Full Exemption)

This is the big one. Florida veterans with a service-connected disability rated 100% permanent and total (P&T) receive a complete exemption from ad valorem property taxes on their homestead, zero property tax on your primary home. The exemption also extends to veterans permanently confined to a wheelchair due to a service-connected injury, regardless of percentage rating.

A separate exemption applies to veterans age 65+ with a combat-related disability: the home's assessed value is reduced by the percentage equal to the veteran's disability rating (a 70% rating reduces taxable value by 70%).

Surviving Spouse Benefits

Florida protects surviving spouses. If a veteran with a 100% P&T disability passes away, the surviving spouse continues to receive the full property tax exemption as long as they:

  • Remain a Florida resident,

  • Do not remarry, and

  • Hold legal or beneficial title to the homestead.

Surviving spouses of servicemembers who died in the line of duty also qualify for a complete homestead exemption. Florida additionally offers a partial property tax refund for the homestead of any servicemember who was deployed during the previous calendar year on a designated military operation outside the U.S.

How to Apply

Applications are filed with your county property appraiser, not the state. Deadlines are March 1 of the tax year. You will typically need:

  • Form DR-501 (homestead application) plus the disability-specific addendum (DR-501DV for the $5,000 exemption, DR-416 for total disability),

  • A current VA disability rating letter,

  • Proof of Florida residency (driver's license, voter registration),

  • DD-214 showing honorable discharge.

Florida Veteran Education Benefits

Federal GI Bill benefits cover most Florida veterans, but the state layers several programs on top, especially for in-state tuition and dependents.

Educational Dollars for Duty Program

The Educational Dollars for Duty (EDD) program, run by the Florida Department of Military Affairs, provides tuition assistance to Florida National Guard members at state public colleges, universities, and career centers. EDD covers tuition and fees up to the in-state rate and stacks with federal Tuition Assistance and the GI Bill. Guard members must remain in good standing and pass each course.

Tuition Waivers for Purple Heart Recipients

Florida public postsecondary institutions waive tuition and fees for Purple Heart recipients and recipients of higher-precedence combat decorations (Medal of Honor, Distinguished Service Cross, Navy Cross, Air Force Cross). The waiver covers undergraduate coursework at all 12 state universities and 28 Florida College System institutions. Veterans must be a current Florida resident or have been a resident at the time of the qualifying action.

Scholarships for Children & Spouses of Deceased/Disabled Veterans

The Scholarships for Children and Spouses of Deceased or Disabled Veterans program, administered by the Florida Department of Veterans' Affairs, provides up to four years of tuition and registration fees at any Florida public postsecondary institution. To qualify, the veteran parent or spouse must have died from a service-connected disability, be 100% permanently and totally disabled from service-connected causes, or be classified as a POW/MIA. Applications are submitted through the Florida Office of Student Financial Assistance.

Florida also grants in-state tuition rates immediately to all honorably discharged veterans living in the state, bypassing the standard 12-month residency requirement.

Veterans' Florida CareerSource Programs

CareerSource Florida is the state's workforce system, 24 regional boards and 100+ career centers. Each center staffs Local Veterans' Employment Representatives (LVERs) and Disabled Veterans' Outreach Program (DVOP) specialists who provide one-on-one job-search support, resume help, interview prep, and hiring-fair connections. Many run workshops at NAS Jacksonville, NAS Pensacola, MacDill AFB, and Patrick Space Force Base.

Veterans' Preference for State Jobs

Under Florida Statute 295, qualifying veterans receive hiring preference for state and local government positions, applied to entry-level civil service hires and promotions. Eligible categories include disabled veterans, wartime veterans, surviving spouses of veterans who died of service-connected causes, and spouses of permanently disabled veterans. Frequently Asked Questions

Are 100% disabled veterans completely exempt from Florida property tax?

Yes. Florida veterans with a 100% permanent and total service-connected disability are fully exempt from ad valorem property tax on their homestead under Florida Statute 196.081. This is a complete exemption, not a reduction. You must own and occupy the home as your permanent residence and provide a current VA rating letter to your county property appraiser. Surviving spouses can continue the exemption if they remain Florida residents and do not remarry.

Does Florida tax military retirement pay?

No. Florida has no state personal income tax, which means military retirement pay, VA disability compensation, Survivor Benefit Plan payments, and Social Security benefits are all entirely state-tax-free. This is one of the largest unspoken financial benefits of retiring in Florida and a major reason the state ranks high for military retirees. You will still owe federal income tax on retirement pay, but Florida itself takes nothing.

Educational Dollars for Duty (EDD) is the Florida National Guard's tuition-assistance program, administered by the Florida Department of Military Affairs. It covers tuition and fees at Florida public colleges, universities, and career centers up to the in-state rate. EDD can be combined with federal Tuition Assistance and the Post-9/11 GI Bill. Eligibility requires active membership in the Florida National Guard and maintaining good standing with passing grades each term.

Can I get a free Florida driver's license as a veteran?

Yes, but only if you have a 100% service-connected disability and are receiving VA disability compensation. Qualifying veterans can get a Florida driver's license or state ID issued at no cost through any Florida DHSMV office. Disabled-veteran license plates are also free. Bring your VA award letter, DD-214, and standard ID documents. Veterans without a 100% rating still pay regular fees but can have "Veteran" added to their license at no extra charge with a DD-214.
